Before giving a statement to the other party’s insurance company, speak with an attorney. Nuttall Brown & Coutts generally advises injured people not to give statements to that insurer before getting legal advice.

This sheet helps you identify the caller, keep the request and prepare to contact our attorneys. It is not preparation for giving a third-party statement.

Identify the caller and the request

  • Record the caller’s name, company and contact information.
  • Ask whom the company insures and note the claim number.
  • Keep any request for a recorded or written statement, documents, authorization or signature.
  • Note any date the caller mentions and save written communications.

You can gather these contact details without trying to explain the accident or answer detailed questions about your injuries. Contact our attorneys before providing a statement to the other party’s insurer.

Your own insurer is different

Your own insurance policy may require cooperation or a statement. Ask an attorney about those obligations rather than ignoring the request. Do not assume our guidance about the other party’s insurer means you can disregard duties under your own policy.

If you are unsure which insurer is calling or whom it represents, keep the contact information and ask our attorneys to help you identify the request.

If you have already given a statement

Tell the attorney when it happened, which company requested it and whether you have a recording, transcript or copy of what you signed. Explain what you remember accurately rather than guessing. An attorney can discuss what the existing statement means for the next steps.

Bring the request to a free case review

Keep the complete request or document, not only a signature page. Tell us about any settlement offer, release or payment you have received.

Call (801) 255-2102 for a free case review. You do not need every report or medical record before calling. You pay no attorney fee unless we recover for you. Ask how case costs are handled under the fee agreement.
